The Bute Trustees opposed the leasing of the Penarth Works to the T.V.R. arguing that it was contrary to the Agreement made in 1849 when the T.V.R. promised to send their traffic through the Bute Docks at Cardiff.

The Bute Trustees brought an action against the T.V.R. claiming damages and payment of coal dues shipped at Penarth as though the coal had been shipped at Cardiff. The Bute Trustees could not force their claim legally, but there was some validity in their case.

The House of Lords found that the covenant of 1849 did not legally bind the Penarth Company but in their view the T.V.R. would be guilty of a breach of faith if they charged lower rates than they were paying at Cardiff.

The effects of this 999 year lease to the T.V.R. were two fold. The Taff Vale Railway supplied a dock which was controlled by the railway company, and so the transport and outlet of coal became more efficient. On the other hand the House of Lord’s decision was to debar the T.V.R. from operating with cheaper rates at Penarth than at Cardiff where they also had tipping facilities.
