Clause (C.) covers the right of to the survey and examination of the works by the Lord High Admiral etc. Conditions relating to abandonment of the works, be it 'in, under, over, through or across the Taff,' or its 'Disease or Decay,' was covered within Clause (D.) which also permitted the Lord High Admiral to reinstate the site and recover costs with Penalty from the Company. Clause (E.) dealt with the proposed swing bridge over the Glamorganshire Canal : - 'For the Protection of the Company of Proprietors of the Glamorganshire Canal (herein after called the Canal Company) and of their Undertaking, the Company shall (except as the Canal Company may otherwise agree) be bound by and comply with the following Provisions and Restrictions : (to wit,) First, the Bridge for carrying the said Road over the Sea Lock of the Canal Company shall be an opening Bridge, not being a lifting Bridge, so constructed that when open the whole of the Canal, and a Space on each Side of the Lock not less than Four Feet from the Edge thereof, shall be left clear and free, and the Width of the said Bridge shall not exceed Ten Feet, and no Pier, Pile, Buttress, or other Work shall be erected or placed in the Canal, or within Four Feet of the Edge thereof on either Side, and the Foundations of the said Bridge shall be so constructed to be clear and entirely distinct from any Part of the Side Walls of the said Lock within Eight Feet of the Edge of the Lock and the Bridge, and the Machinery and Motive Power shall be affixed and applied on the North Side of the said Sea Lock : Second, where the said Road or Bridge crosses the said Sea Lock, or passes through any Lands belonging to the Canal Company to the Northward thereof, no lateral Deviation from the Centre Line of the Road shown on the deposited Plans, nor any vertical Deviation upwards, exceeding Two Feet from the Levels thereof as shown in the deposited Sections, shall be made : Third, the Lands and Houses respectively numbered on the deposited Plans from 24 to 35 (inclusive of both these Numbers) and 50 in the Parish of Saint Mary Cardiff shall not be purchased, taken, used or interfered with : Fourth, the Properties numbered on the deposited Plans 48 and 49 in the same Parish shall not be taken, used, or interfered with further or otherwise than may be necessary for forming the proposed Road and Bridge : |
