Volume Nine - Pre-Victorian to the present day - even more aspects - Swing Bridge Connections : Penarth Dock, River Taff and Glamorganshire Canal . . . Fifth, if and whenever, in the Execution of the Powers of this Act, and House or Building belonging to the Canal Company on the North side of the Canal shall be wholly or in part pulled down, or so injured as to rendered uninhabitable, the Company shall, at their own Expense, and within Six Months after the Canal Company shall have given them Notice in Writing under the Hand of their Clerk so to do, and on such Part of the Land of the Canal Company as they shall in such Notice prescribe, erect another similar House or Building of equal Value, Materials, Capacity, and Convenience, to the reasonable Satisfaction of the Canal Company : Sixth, before the Company shall commence the Construction of the Bridge over the Sea Lock and so much of the said Road as is to be made in or through any Lands of the Canal Company the Company shall furnish to the Canal Company proper and sufficient Plans, Sections, and Specifications thereof, for their Approval ; and any Differences between the Two Companies or their respective Engineers which may arise thereon shall be settled by Arbitration ; and the Company shall not commence the Construction of the said Works until such Plans, Sections, and Specifications have been approved of : Seventh, the said Bridge and such other Works as aforesaid shall be executed only according to the Plans, Drawings, and Specifications so approved, and the Construction and all subsequent Repairs shall be executed to the reasonable Satisfaction of the Engineer for the Time being of the Canal Company, and his reasonable Charges and Expenses in reference to the Matters aforesaid shall be paid by the Company : Eighth, the Company shall at all Times, at their own expense, maintain the said Bridge and Portion of Road, and other Works in, over, or affecting the Lands or Works of the Canal Company, in complete and substantial Order and Condition, to the reasonable Satisfaction of the Engineer for the Time being of the Canal Company : Ninth, if and whenever the Company fail to fulfil any of the foregoing Stipulations with respect to the Construction or Maintenance of the said Bridge and Works, the Canal Company may make and do, in and upon as well the Lands of the Company as their own Lands, all such Work and Things as the Canal Company think requisite in that Behalf, and their reasonable Expenditure in that Behalf shall from Time to Time be repaid to them by the Company, and in default of Repayment such Expenditure may be recovered from the Company, with full Costs, in any Court of competent Jurisdiction : |
